School leaders may feel confident in their policies, but when it comes to putting those policies into practice, some challenges are proving much harder to navigate.
We polled a room full of school leaders at the Legal & Governance Essentials for School Leaders earlier this year and a clear theme emerged: people-related issues are where the uncertainty lies.
1. Employment matters lead the pressure points
When asked about the biggest legal or governance pressure facing their school, 34% of delegates selected employment matters, narrowly ahead of student behaviour and discipline at 30%.
Privacy, information requests and complaints were also significant, at 20%, while board governance and decision-making accounted for 11%.
2. Confidence is high, but complexity remains
Despite these pressures, school leaders appear confident in the policies supporting their decisions. Almost all delegates – 98% – said they were either very or somewhat confident that their current policies would stand up to legal scrutiny.
But having a sound policy framework is one thing. Applying it to difficult situations is another.
3. Staff issues are the biggest source of uncertainty
The audience overwhelmingly identified staff performance or conduct as the area creating the most uncertainty for their leadership team. That was far ahead of managing online harm or social media issues, with student suspensions and parent complaints being mentioned also.
The responses suggest that the challenge is not simply knowing what the rules are. It is knowing how to apply them correctly when situations become complex.
4. Key takeaways: Know the rules, document everything.
Finally, a concluding poll at the end of the event (“What are your event takeaways?”) highlighted the importance of knowing policies, following due process, applying natural justice and keeping clear records. Are you staying up-to-date across all your management duties at school?
